before using the KaaAfrika Kula online and mobile food ordering and delivery
application ("KaaAfrika Kula" or the "Application")
provided by KaaAfrika Smart Tech LTD or HIM Incorporated (“KaaAfrika”, "HIM,"
"we," "us," or "our"). These Terms outline the
rights and obligations of all users ("Users," "you," or
"your") of KaaAfrika Kula. By using KaaAfrika Kula, you agree to
comply with these Terms. If you do not agree with these Terms, please do not
use the Application.
1. Acceptance of Terms
By accessing or using KaaAfrika Kula, you acknowledge that you
have read, understood, and agreed to these Terms. If you are using KaaAfrika
Kula on behalf of a business or organization, you represent and warrant that
you have the authority to bind the entity to these Terms.
2. Use of KaaAfrika Kula
2.1. Eligibility: To use KaaAfrika Kula,
you must be at least 18 years old. By using the Application, you confirm that
you are of legal age to enter into a binding contract.
2.2. User Account: To access certain features
of KaaAfrika Kula, you may be required to create a user account. You are
responsible for maintaining the confidentiality of your account information and
for all activities that occur under your account. You agree to provide
accurate, current, and complete information during the registration process.
2.3. Prohibited Activities: When using
KaaAfrika Kula, you agree not to engage in any of the following activities:

Impersonating any
person or entity.

Posting false, inaccurate,
or misleading information.

Violating any
applicable laws or regulations.
·
Harassing, abusing, or
harming others.
·
Using the Application
for any illegal, fraudulent, or unauthorized purpose.

Attempting to gain
unauthorized access to the Application or its related systems.
·
Interfering with the
proper operation of KaaAfrika Kula.

3. Food Ordering and Delivery
3.1. Restaurant Listings: KaaAfrika Kula
provides information about various restaurants and their menus. While we strive
to ensure accuracy, we do not guarantee the availability or quality of the
items listed. The restaurants are solely responsible for the preparation and
delivery of food items.
3.2. Delivery Drivers: Delivery drivers
are independent contractors who are responsible for delivering orders placed
through KaaAfrika Kula. We conduct background checks on drivers, but we do not
control their actions. If you have any concerns about a delivery driver, please
contact us immediately.
4. Payment and Fees
4.1. Pricing: Prices for food items, delivery
fees, and applicable taxes are determined by the respective restaurants. HIM
does not control or set these prices.
4.2. Payment: You agree to pay all
charges incurred through your use of KaaAfrika Kula, including the cost of food
items, delivery fees, and taxes. Payment will be processed through the
Application using the payment method you provide.
5. Dispute Resolution
Any disputes between Users, restaurants, or delivery drivers
related to KaaAfrika Kula should be resolved directly between the parties
involved. HIM is not responsible for disputes or damages arising from the use
of the Application.
6. Termination
We reserve the right to terminate or suspend your access to
KaaAfrika Kula at our discretion, without notice, for any reason, including if
we believe you have violated these Terms.
7. Changes to Terms
HIM may update these Terms from time to time. Any changes will
be posted on the Application, and your continued use of KaaAfrika Kula after
the posting of changes constitutes your acceptance of the modified Terms.
